HSPRD and co-counsel have cleared a major hurdle to move forward the class action lawsuit against Alden Group Ltd. and Alden Management Services Inc. and six of the Alden nursing facilities in Northern Illinois. A Cook County judge denied Alden’s motion to dismiss the case and allowed the residents to pursue the claims and seek records and sworn testimony from company leadership and staff. The lawsuit alleges that six Alden nursing homes across the Chicago area were systematically understaffed, at times operating at roughly half of required levels, resulting in unsafe, unsanitary, and dangerous conditions for residents.
In his ruling, Cook County Judge Myron Mackoff found that, if proven, the allegations would show that Alden violated the Nursing Home Care Act and Illinois Consumer Fraud Act. Plaintiffs seek to represent thousands of residents of these facilities in recent years to seek a court order to improve the care at the facilities and compensation for past violations of the law.
